Work permit handling procedures for foreign employees in China

I. Foreignexperts applying for "work permit" in China shall observe the Chineselaws and regulations, be in good health, possess clean criminal record and meetone of the following conditions:
   (I). Foreign top talents (ClassA): 1. be considered in the talents introduction program of China; 2. meet theinternationally recognized professional achievement identification standards;3. meet the requirements of market-oriented encouraging jobs; 4. innovative andentrepreneurship talents; 5. outstanding young talents; 6. with a score ofabove 85 points. (II). Foreign professionals (Class B): 1. have obtained thebachelor’s degree and above as well as two or over two years of relevant workingexperience; 2. hold the internationally common professional skill certificationor serving as scarce technical talents; 3. foreign language teaching personnel;4. average income not lower than 4 times of local social average income of lastyear; 5. meet the requirements of relevant national authorities andimplementing programs; 6. professional talents with a score of above 60 points.(III). Other foreign personnel (Class C): 1. meet the current administrativeregulations of China on foreign personnel working in China; 2. engage intemporary and short-term (no more than 90 days) work; 3. personnel subject tothe quota system management, including foreign youth came to China forinternship according to inter-government agreement, qualified overseas studentsand overseas graduates from overseas colleges and universities as well asforeigners working in the special fields like distant fishing.


II. Application materials

1. Application letter
  2.Application Form for Foreign Employees to Work in China;

3. Resume (including the information on education background andworking experience) and photocopies of passport;
   4. Photocopies of the highestacademic certificate or professional qualification certificate;
   5. Originals of healthcertificate issued by the foreign health and medical institutes recognized bythe overseas embassy and consulate of China or health and quarantine authoritiesassigned by the Chinese government and clean criminal records;
  6. Employment contract or agreement;
 7. Companies hiring foreigners for thefirst time are required to provide organization code certificate or relevantregistration certificate.


III. Handling time

Seven workdays (not include the time for thesupplement and correct of applicant’s materials) for handling and ten workdaysfor permit preparation and issuing. Special cases shall be handled separately.


IV. Handling procedures

1. Apply online. Employers shall first log in the "servicesystem for administration on foreigners working in China" (website: http://www.safea.gov.cn) tosubmit the application information and relevant electronics materials online.Ones entrusting professional service agencies with the handling procedures needto register the name of professional service agency, the legal registrationcertificate (like business license or organization code certificate, socialinsurance registration certificate or registration certificate of residentrepresentative office of foreign enterprise), and the name, identitycertificate and contact number of the agent, and submit the engagement letterof employer and identity certificate of the agent.

2. Pre-review online. Materials submitted online will bepreviewed within 5 workdays after the submitting (the submitting day will notbe included) as of the date of submitting the materials. If materials are notcomplete or not standard in content, the applicants shall be informed onlinefor material supplement and correcting. If the materials are complete and meetthe content specifications, the applicants will be informed online to submitmaterials or make an appointment to submit the materials.
   3. Acceptance. After onlinepre-review, the paper materials will be reviewed. If the application materialsare complete and all conform to the requirements, the Work Permit Acceptance Form for Foreigners to Work in China will beissued immediately. If the materials are not complete or not in legal form, anotification of supplement and correcting will be issued and the supplementedand corrected materials will be accepted. If it is beyond the sphere of thefunctions and powers of the administrative authority, the reasons and basis fornot accepting shall be provided and relevant notification shall be issued anddelivered to the applicant or employer within 5 days after receiving the papermaterials.
  4. Review and decision making. Afteracceptance of the paper materials, the online review shall be conducted anddecision shall be made within 10 workdays (the submitting day will not beincluded). In order to apply for the WorkPermit for Foreigners to Work in China, the employer shall submit theoriginal copies of employment contract or employment certificate, jobqualification certificate, clean criminal record certificate, certificate ofphysical examination, the highest diploma, etc.
